Universal Terms of Service Agreement


PLEASE READ THIS GENERAL TERMS OF SERVICE AGREEMENT CAREFULLY, AS IT CONTAINS IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS AND REMEDIES.

eTourist Services Pvt Ltd (“eTourist,” “Company,” “we,” “our,” or “us”) is a private visa‑facilitation agency. We are not the Department of Immigration & Emigration of Sri Lanka and have no authority to grant or refuse Electronic Travel Authorisations (ETAs) or e‑Visas. Final decisions rest exclusively with the Government of Sri Lanka. Please read these Terms carefully—using our website, mobile app, or any associated services (collectively, the “Service”) means you accept them in full.

Term Meaning
Application Any web‑ or mobile‑based software branded eTourist that enables Users to apply for a Sri Lanka ETA/e‑Visa.
Government Fee The mandatory, non‑refundable fee charged by the Government of Sri Lanka for processing an ETA/e‑Visa.
Processing Fee eTourist’s service fee for reviewing, translating, submitting, tracking and supporting your application.
Order A request initiated by You to use eTourist’s Service, including the payment of any applicable fees.
User,” “you,” or “your Any individual or legal entity that accesses or uses the Service.
2  Acknowledgment
(2.1)  These Terms govern your use of the Service and form a legally binding agreement between you and eTourist.
(2.2)  They apply to all visitors, users, and others who access or use the Service.
(2.3)  If you do not agree with any provision herein, do not continue. By proceeding, you confirm you have read, understood, vand accepted these Terms.
(2.4)  This document is an electronic record under the Information Technology Act, 2000 and applicable rules; it does not require physical or digital signatures.
(2.5)  You represent that you are at least 18 years old. Minors may use the Service only with verifiable parental consent.
(2.6)  Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and share personal data.
(2.7)  Visa approval or refusal is solely at the discretion of the Sri Lankan authorities. eTourist is not liable for any delay, request for extra documents, or rejection.
(2.8)  Estimated time‑lines or appointment slots displayed in the Application are indicative and not binding on eTourist.
3  Placing Orders for Services

By placing an Order, you warrant that you are legally capable of entering into binding contracts and that all information provided is true, accurate, current, and complete.

4  Your Information & Responsibilities

(4.1) Registration requires you to provide personal and payment details (passport data, PAN, card numbers, etc.).
(4.2) You confirm:
You are authorised to use the payment method supplied;
All information is accurate and not misleading;
You will respond to eTourist communications within 24 hours—failure may result in cancellation without liability to eTourist;
You have carefully reviewed the data shown at each step of the Application; you alone are responsible for errors.

(4.3) You authorise eTourist to share your information with payment processors and, where necessary, foreign missions or third‑party partners to complete your Order.
(4.4) Where foreign consulates require forms to be completed online or offline, you authorise eTourist to fill and submit those forms on your behalf based on the data you supplied.
(4.5) If you opt into promotional offers (e.g., complimentary insurance or a prepaid forex card), you authorise eTourist to share only the data necessary to fulfil that offer with the relevant provider. Responsibility for those ancillary services rests with the provider, not eTourist.

5  Order Cancellation & Refunds

(5.1) eTourist may cancel an Order at any time for reasons including, but not limited to:
(a) Third‑party system downtime;
(b) Force‑majeure events;
(c) Incorrect or incomplete user data;
(d) Lack of user response within 24 hours.

(5.2 We may also cancel an Order if fraud or unauthorised payment is suspected.
(5.3) Refunds
(a) Before submission to the Government: 100 % of the Government Fee and 50 % of the Processing Fee are refundable.
(b) After submission: All fees are non‑refundable unless covered by “eTourist  Protect” (displayed at checkout).
(c) Government rejection, travel‑plan changes, or user errors are not grounds for a refund.

(5.4) If you overstay in Sri Lanka without proper authorisation, you alone are liable for penalties; eTourist bears no responsibility.

6  Fees, Pricing, and Payment

(6.1) All prices are quoted in U.S. dollars unless stated otherwise and may change without notice prior to Order acceptance. You are responsible for any applicable taxes.
(6.2) Post‑acceptance price changes: if external factors (e.g., currency swings, new government charges) materially increase costs, eTourist will notify you and you may cancel without penalty.
(6.3) The consular visa fee schedule is available at https://www.esta.org.lk (subject to change by the Sri Lankan Government without notice).
(6.4) Payment methods include Visa, MasterCard, AmEx, PayPal, UPI, net‑banking, and others displayed at checkout. Card transactions are subject to issuer authorisation.

7  Promotions

Participation in any promotion is governed by its own rules. If those rules conflict with these Terms, the promotion rules prevail.

8  User Accounts

8.1 You must maintain accurate account details and safeguard your credentials.
8.2 You are liable for all activity under your account. Promptly notify eTourist of any unauthorised use or security breach.
8.3 Transmitting sensitive personal data is at your own risk; eTourist employs reasonable safeguards but cannot guarantee absolute security.

9  Intellectual Property

All content, design, and software forming part of the Service are the exclusive property of eTourist or its licensors. You receive a limited, revocable licence to use the Service solely for personal, lawful purposes.

10  Links to Third‑Party Sites

eTourist is not responsible for the content or practices of third‑party sites linked within the Service. Review their terms and privacy policies independently.

11  Termination

eTourist may suspend or terminate access, with or without notice, for any breach of these Terms. Sections relating to fees, intellectual property, disclaimers, limitations of liability, and dispute resolution survive termination.

12  Limitation of Liability

To the fullest extent permitted by law, eTourist’s total liability under any claim shall not exceed the Processing Fee you actually paid or USD 100—whichever is lower. eTourist shall not be liable for indirect, incidental, consequential, punitive, or special damages, loss of data, business interruption, or visa refusal.

13  Indemnification

You agree to defend, indemnify, and hold harmless eTourist, its affiliates, officers, and employees from any claim or demand arising out of your breach of these Terms, misuse of the Service, or violation of any law or third‑party right.

14  “AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided without warranties of any kind—express, implied, statutory, or otherwise—including merchantability, fitness for a particular purpose, non‑infringement, availability, or error‑free operation.

15  Courier & Document Handling Disclaimer

eTourist uses third‑party couriers. We are not responsible for delays, loss, or damage to documents once they are in transit. Your only recourse in such events is against the courier company.

16  Acceptable Use & Restrictions

You may not:
Decompile, reverse‑engineer, or modify any part of the Service;
Remove copyright or trademark notices;
Post unlawful, defamatory, or offensive content;
Use the Service for any purpose that violates applicable laws.

17  Further Indemnity & Liability Limits

eTourist shall not be responsible for user‑generated content or for losses relating to any overstay or immigration violation by the User.

18  Miscellaneous
(18.1) eTourist’s role is limited to preparing and submitting visa applications; approval rests with the Sri Lankan authorities.
(18.2) Overstay penalties or other legal consequences are solely your responsibility.

19  Force Majeure

eTourist is not liable for delay or failure caused by events beyond its reasonable control (acts of God, war, strikes, network failures, etc.).

We endeavour to acknowledge grievances within 48 hours and resolve them within 30 days.

21  Governing Law

These Terms are governed by the laws of India. Courts in New Delhi have exclusive jurisdiction.

22 . Dispute Resolution

(22.1) In the event of any dispute, controversy, or claim arising out of or relating to the validity, interpretation, performance, breach, or termination of these Terms and Conditions (including any non-disclosure obligations), you agree to first attempt to resolve the matter amicably by notifying and discussing the issue with eTourist.
(22.2). If the dispute is not resolved within forty-five (45) days from the date of referral for informal resolution, the matter shall be finally resolved by arbitration, in accordance with the provisions of the Arbitration and Conciliation Act, 1996, and any statutory amendments or re-enactments thereof.
(22.3). The arbitration shall be conducted by a sole arbitrator, appointed solely by eTourist. The proceedings shall be held in the English language, and the arbitration award shall be final, binding, and substantiated in writing.
(22.4). The entire arbitration process shall be completed within one hundred and eighty (180) days from the reference date. The seat and venue of arbitration shall be New Delhi, India, and the parties irrevocably submit to the jurisdiction of courts at New Delhi for all arbitration-related matters.

23  Severability & Waiver

If any provision is unenforceable, it will be interpreted to fulfil its intent as closely as possible; remaining provisions remain in force. Failure to enforce any right is not a waiver of future enforcement.

24  Language

If these Terms are translated, the English version prevails in the event of conflict.

25  Changes to Terms

We may amend these Terms at our sole discretion. Material changes will be posted 30 days before taking effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.
